Finanzexpert Schweiz GmbH, based in Zurich (hereinafter "Finanzexpert"), operates this internet portal and other service and price comparisons, in particular for financial and insurance products (hereinafter the "portal"). These terms of use regulate the rights and obligations of the users of the portal (hereinafter the "users") when using the portal and all other services of Finanzexpert in connection with the portal.
1 – Offer and Use
On the portal, Finanzexpert publishes information on financial and insurance products, in particular service and price comparisons (hereinafter the "information"), and mediates professional advice and mediation of such and other financial and insurance products desired by the users (hereinafter the "advice and mediation", collectively hereinafter the "offer"). The offer does not constitute an invitation or recommendation to purchase or otherwise obtain a service or product and is non-binding for the users.
The offer is exclusively directed at natural persons with full legal capacity residing in Switzerland and is available to them free of charge and without obligation for private use. Any use by legal entities and any commercial use is prohibited. The users waive all potential claims for commissions and other compensation from advice and mediation, as well as from third parties in favor of Finanzexpert in connection with the offer.
Users have no claim to use the portal and can be excluded from using the portal by Finanzexpert at any time without giving reasons, either temporarily or permanently. Using the portal in a way that could endanger its proper operation is prohibited. Users must refrain from any excessive use of the portal – in particular, automated use by means of software other than that of the portal.
2 – Quality
Finanzexpert strives for the highest possible quality of the offer, but expressly refrains from any direct or indirect warranty or representation regarding the quality of the offer, such as with regard to the timeliness, accuracy, and completeness of the information. If user information is necessary for using the offer, the users undertake to transmit only correct and complete information to Finanzexpert. In the case of incorrect or incomplete information, the users are fully liable for any damages incurred by Finanzexpert as a result.
Third parties whose advice and mediation is mediated to the users by Finanzexpert (hereinafter the "advisors and mediators") are specifically obliged to carry out their advice and mediation towards the users with the greatest possible care and professionalism at all times, and to fully comply with applicable Swiss law and the applicable professional, provider, and industry-specific recommendations, guidelines, and other applicable provisions. Users for whom no advice and mediation is possible must be informed by the respective advisors and mediators about alternative advice and mediation options, including direct and – if available – free advice and procurement options from the respective providers of the desired financial and insurance products.

3 – Liability
Any liability of Finanzexpert for direct damages from the offer and in connection with the portal is expressly excluded, subject to mandatory legal provisions. Any liability of Finanzexpert for indirect damages or consequential damages from the offer and in connection with the portal is fully and expressly excluded. Finanzexpert is particularly not liable for damages caused by advisors and mediators or information, or due to functional disruptions of the portal, disruptions at agents and other third parties, or errors in the transmission of electronic messages.
The availability of the portal can be partially or completely restricted at any time and without giving reasons. Finanzexpert is not liable for the temporary unavailability of the entire portal or individual functions of the portal, or for errors in individual functions of the portal.
4 – Data Protection
Finanzexpert is subject to Swiss data protection law and generally stores personal and other data on servers in Switzerland. Finanzexpert collects and processes, in particular, data that users transmit directly to Finanzexpert via forms on the portal, via apps connected to the portal, or in another way. This data includes, for example, names, postal addresses, email addresses, telephone numbers, dates of birth, gender, family relationships, and wishes regarding financial and insurance products. Other data, such as date and time stamps, IP addresses used, browsers and operating systems used, and any shared location information, are generated at Finanzexpert through the use of the portal.
Finanzexpert may use all collected data for any purposes in connection with the operation of the portal and the offer and is entitled to keep all data for ten years. Finanzexpert takes appropriate measures to protect this data.
Users who have information as well as advice and mediation mediated by Finanzexpert via the portal expressly agree that the data collected and processed by Finanzexpert for this purpose will be transmitted to advisors and mediators. If a telephone appointment is agreed upon – by mutual consent – after the transmission of the data to advisors and mediators, the advisors or mediators reserve the right to invoice the costs incurred in case of absence – without early cancellation within 24 hours. Advisors and mediators are obliged to fully comply with Swiss data protection law at all times.
Finanzexpert is authorized to transfer personal and other data to third parties or have it transferred by third parties within the framework of the transfer or exercise of rights and obligations from these terms of use and in connection with the operation of the portal. In the event of any data transfer abroad, Finanzexpert takes appropriate measures to ensure a data protection standard that corresponds to that in Switzerland.
For the analysis of the use of the portal and for displaying advertisements, Finanzexpert may use third-party services in Switzerland and abroad, such as the "Google Analytics" and "Google AdSense" services of the American Google Inc. When using such services, IP addresses, cookies, and other data – possibly also personal data – of the users regarding their use of the portal may be transmitted to third parties abroad and there to countries whose data protection standard may not correspond to that of Switzerland.

5 – Other Provisions
By using the portal, users acknowledge these terms of use. Finanzexpert can supplement or otherwise change these terms of use at any time and without giving reasons. The currently valid terms of use as published on the portal apply. If users do not agree with a change to these terms of use, further use of the portal is not permitted.
Should individual provisions of these terms of use be invalid or void, the validity of the remaining provisions of these terms of use shall not be affected. An invalid or void provision is to be replaced by a legally permissible provision that comes closest to the original economic purpose.
The use of the portal is subject exclusively and fully to Swiss substantive law.
The exclusive place of jurisdiction is Zurich, Switzerland.
